BK’s long-awaited alibi was filed by Anne Taylor on the day of the deadline, and unsurprisingly, it seems like most of the media and people following this case don’t understand what she’s saying…. so let’s break it down:
BK isn’t just claiming he was “stargazing” with nothing to back it up. He took photos of the stars with his phone. UPDATE 5-6-25: I was under the impression Bryan had an iPhone, mostly due to the search warrants to Apple under his name, but I have since learned that he had an Android. Just to double check, I ran the same experiment with my boyfriend's Android phone, and everything still worked exactly the same.
I have an iPhone, and I occasionally use it to take “light painting” pictures. Here’s an example of a photo I took with my iPhone:
My point is, in order for your phone to take even remotely decent low-light pictures, you have to use an app. (UPDATE 5-6-25: in recent months Apple released an iOS update which included the capability for the default phone camera to take low light/nighttime photos, so an app is no longer required for this. I tried my experiment using the default phone camera, and it still worked.) Two apps that I’ve used are Slow Shutter Cam and NightCap Camera.
The default iPhone camera doesn't have the ability to take long exposure pictures, because there’s no way to control your shutter speed (please see my update above). With these apps, your phone camera can do that. The alibi document specifically says that the phone data contains pictures of the night sky. This tells me that he must have been using one of these apps to take pictures - unless he wanted pictures of the night sky that look like this:
Lol I made this in a photo editing app, but it’s legitimately not far off. If you don’t believe me, go to an area with very little light pollution (like Wawawai Park) and use the default camera app on your phone to take a picture of the night sky. I promise, it will look very similar to what I presented above (UPDATE: sorry, I know this is no longer the case, but it was true when I wrote the article).
So, let’s see what the PCA says about BK’s phone during the time that law enforcement claims the murders happened:
Wait… a query of BK’s phone did NOT show it utilizing cellular tower resources in close proximity to 1122 King Rd between 3 am and 5 am (aka his phone didn’t connect to the same AT&T cell tower that provides coverage to 1122 King Rd)?? Well, that’s interesting. So what’s their explanation for that?
Okay so they don’t even know if BK did in fact turn his phone off. It could just be that he was in an area with no cell service… like Wawawai Park. Interesting, right?
With this information in mind, I decided to do a little experiment. I wanted to know if a picture is taken with one of the apps I mentioned earlier when your phone has no cell service, does it still save your location in the EXIF data?
So the first thing I did was turn off WiFi and cellular data to my iPhone. I also have AT&T, not sure if it matters, but I just thought I’d include that info. Here’s my phone with the WiFi and cell data turned off:
With that taken care of, I opened the Slow Shutter app and snapped a quick picture of the floor of my back porch:
I edited out the name of my town for privacy reasons, but needless to say, the location data was EXTREMELY accurate. This honestly made me so excited, because I have believed for quite some time that BK is being framed for these murders. Call me a conspiracy theorist, I don't care. I feel very strongly that in the end I will be vindicated.
Then I did the same experiment again, only this time I used the app NightCap Camera. Remember, I have WiFi and cell service turned off on my phone, as a way to simulate being in an area with no cell coverage. Again, I snapped a quick picture of the floor of my back porch:
Well how about that?? Same result! The EXIF data again shows my PRECISE location, all the way down to which house I'm in! I could've zoomed in even closer on the map, but I chose not to. In my opinion, this is a HUGE DEAL.
So what else does the PCA say about BK’s phone connecting to cell towers?
I had to significantly lighten the map because for some reason, the one they included was so dark that you couldn't see anything. I'm sure that wasn't intentional or anything 😒… Anyway. Notice how it says “this is a possible route based off of celluar (cellular?) device location”. How would they have possibly come to this conclusion when his phone was not reporting to AT&T from 2:47 am until 4:48 am? It's mind-blowing they thought this was going to be enough to prove he was at 1122 King Rd that night and committed the murders. They even undermine their own “evidence” by saying “investigators found that the 8458 Phone did connect to a cell phone tower that provides service to Moscow on November 14th, 2022, but investigators do not believe the 8458 Phone was in Moscow on that date”. Why do people not realize how that sentence completely delegitimizes all of their other claims about BK’s phone “utilizing cellular resources that provide coverage” in a specific area?
And what about those gaps in the yellow line? What is that blue line near Pullman WA supposed to represent? What do the red and blue triangles mean? The whole thing is an absolute joke.
So what else does the PCA say about the estimated location of BK's phone?
They've done something very sneaky here - they mention looking at the historical cell tower data for his phone to see if he was “stalking the victims”. Then in the next paragraph, they say in an overly verbose way that BK’s phone connected to the same cell tower that provides service to 1122 King Rd at least twelve times prior to the murders, thus implying that BK must have been stalking the house.
But that’s just not what it means. At all. I am working on another Substack post diving deeper into the AT&T cell towers in the area and their coverage areas compared to the claims made in the PCA, so I won’t get into all of that right now. But notice the last sentence:
“All of these occasions, except for one, occurred in the late evening and early morning hours of their respective days.”
Now from BK’s alibi:
I love that Anne Taylor used Brett Payne’s own words against him here. So based on this statement, the defense has multiple pictures with precise location data proving BK was nowhere near 1122 King Rd. In fact, let’s see just how far away Wawawai Park is from 1122 King Rd:
So the fastest you could drive from one location to the other is 42 minutes, if you’re following the speed limit. If you’re speeding, maybe 25-30 minutes at best? A lot of the route (regardless of which one you take) is on curvy mountain roads. There’s no 70 mph interstate connecting the two locations.
If you read reviews for Wawawai Park on TripAdvisor and Google Maps, it’s mentioned several times that there’s no cell service there. I checked a coverage map to confirm this:
So for the area around the lake/river there’s poor AT&T service, and closest to the park it shows there’s no service at all. So despite what the Goncalves family said in their Facebook post, BK’s alibi actually DOES match the PCA - his phone was in an area with no cell service.
Another thing the Goncalves family mentioned in their Facebook post is how long it took for his alibi to come out. The defense has said for months that BK was out driving that night, and was not at 1122 King Rd. My guess is that the only reason it took this long for more specific details to come out is because the prosecution was withholding this exculpatory evidence from the defense. Anne Taylor says as much in the alibi:
So if you want to blame anyone for how long all of this is taking, blame the damn prosecution. They need to hand over everything, now.
